Default: Once you have missed three (3) mortgage payments, your lender will declare your loan in default and accellerate the payments making the entire balance due immediately.

Steps to avoid a foreclosure acton: Once there is a default and even prior to default, you should contact the bank to discuss options to get back into repaymet status if it is at all possible. Options might include a forebearance or a temporary reduced payment plan.  

Commencement of Foreclosure action: Upon default, a lender will send you a Notice of Intent to Foreclose advising you of the right to reinstate your loan by fully paying off the missed payments within 30 days. If you cannot make that payment, the lender will go forward with filing the foreclosure action to enforce the note and mortgage.

35 Days to respond: The sheriff's office will serve you with a Summons and Complaint in foreclosure which requires your immediate attention to avoid a default judgment. An answer or other filing must be filed within 35 days of your receipt of the summons and complaint.
